Terms of Service

1. Acceptance of Terms

By accessing or using The Permit Test (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you are under 18, you may use The Permit Test only with the involvement and consent of a parent or legal guardian.

2. The Service

The Permit Test is owned and operated by Manhattan Intelligence LLC, a Florida limited liability company (“The Permit Test,” “we,” “us”). The Service provides educational study materials for driver knowledge exams, including practice questions, study guides, flashcards, and AI-assisted tutoring. The Service is a private study aid. It is not affiliated with, endorsed by, or a substitute for any state Department of Motor Vehicles or other government agency.

We do not guarantee that you will pass any official examination. Official exam content, format, and requirements are controlled solely by state agencies and may change without notice.

3. Accounts and Eligibility

Certain features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it current.

4. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis (monthly or every 3 months) until canceled. Cancellation takes effect at the end of the current billing period. Details, including the money-back guarantee, are in the Subscription Terms and Refund Policy, which are incorporated into these Terms.

5. Intellectual Property

All content on the Service — questions, explanations, study guides, sign illustrations, software, and design — is owned by The Permit Test or its licensors and protected by copyright and other laws. You receive a limited, personal, non-transferable, non-commercial license to use the Service for your own exam preparation. You may not copy, scrape, redistribute, resell, or create derivative works from our content.

6. Acceptable Use

You agree not to misuse the Service, including by attempting to access it through automated means, interfering with its operation, circumventing usage limits or paywalls, or using it to violate any law. The Acceptable Use Policy is incorporated into these Terms.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Driving laws vary by state and change over time; always verify current rules with your state's official driver handbook.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PERMIT TEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Permit Test and its owners, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your violation of any law or the rights of a third party; or (c) content you submit to the Service. This obligation survives termination of these Terms.

10. Dispute Resolution; Binding Arbitration; Class Action Waiver

Informal resolution first: before filing any claim, you agree to contact us at the address below and give us 30 days to work with you to resolve the dispute informally. Most concerns can be resolved this way, quickly and at no cost.

Binding arbitration: any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision is final and enforceable in any court of competent jurisdiction. You and The Permit Test each waive the right to a trial by jury.

Small-claims carve-out: either party may instead bring an individual claim in small-claims court where you live, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

CLASS ACTION WAIVER: ALL DISPUTES MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

Opt-out: you may reject this arbitration provision (except the jury-trial waiver for IP claims) by emailing support@thepermittest.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms.

Time limit: to the extent permitted by law, any claim arising from the Service must be filed within one (1) year after the events giving rise to it, or it is permanently barred.

11. Changes and Termination

We may modify or discontinue the Service or these Terms at any time. Material changes will be announced on this page with an updated effective date. Continued use after changes constitutes acceptance. We may suspend or terminate access for violation of these Terms.

12. General Provisions

Severability: if any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full effect. Waiver: our failure to enforce any provision is not a waiver of it. Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Entire agreement: these Terms, together with the policies they incorporate, are the entire agreement between you and The Permit Test regarding the Service. Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.

13. Governing Law and Contact

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 10. Questions: support@thepermittest.com.
