Alcohol, Drugs, and Driving: The Laws Every New Driver Is Tested On

The impaired-driving section is heavily weighted on every state's test, and for new drivers it carries a twist many miss: the adult limits you've heard about don't apply to you. Under-21 drivers live under zero-tolerance laws, where the practical limit is zero.

The three BAC numbers

0.08% is the adult per-se limit in most states (Utah uses 0.05%) — at or above it, you are legally intoxicated, no other evidence needed. 0.04% is the federal limit for commercial drivers. And for drivers under 21, zero-tolerance laws set the threshold at 0.00 to 0.02% depending on state — a single drink can put a teen driver over. The test asks all three; know which applies to whom.

Impairment starts far below any legal limit. Judgment — the skill you need most — degrades first, which is why 'I feel fine' is the least reliable sentence in driving.

Implied consent

By accepting a license, you've already agreed to chemical testing (breath, blood, or urine) when lawfully arrested on suspicion of impaired driving. Refusing the test isn't a loophole: it triggers automatic license suspension — often longer than a failed test would bring — and the refusal can be used against you in court.

Only time sobers

The liver clears roughly one standard drink per hour, and nothing accelerates it. Coffee makes an alert drunk; cold showers make a wet one. A 'standard drink' is also smaller than people assume — a 12-ounce beer, a 5-ounce glass of wine, and a 1.5-ounce shot all contain the same alcohol, so 'I only had beer' earns no discount.

Drugs, prescriptions, and open containers

Impaired driving laws cover every impairing substance: illegal drugs, marijuana (legal or not), and prescription or over-the-counter medicines that slow you down — a DUI on doctor-prescribed medication is still a DUI. Open-container laws add a separate offense: an opened alcoholic beverage in the passenger compartment is illegal in nearly every state, for passengers as well as drivers.
